Ruchell Cinque Magee, a U.S. political prisoner who has served over 58 years in California prisons, was again denied parole July 15 by the state’s Board of Parole Hearings. Why won’t the state of California allow Magee to go free?
His story begins as a Black man from Louisiana, who since has had to deal with this racist injustice system. Magee remains in prison today because he participated in a bold, heroic action in an attempt to free political prisoners George Jackson, John Clutchette and Fleeta Drumgo, known as the Soledad Brothers, over 50 years ago.
Magee grew up in Louisiana; and at the age of 16, he faced a racist conviction in for “attempted aggravated rape” for having a relationship with a white girl in an area dominated by the Ku Klux Klan.
His conviction occurred at the same time that Emmett Till was lynched in Money, Miss., for supposedly whistling at a white woman. Magee was sentenced to eight years in Angola State Prison. He was legally ordered to leave Louisiana in ; and when finally released from Angola in , Magee went to Los Angeles. ()
Magee was arrested that same year after a disagreement with someone about a $10 bag of marijuana. After his arrest,
Unrepentant Political Prisoner Ruchell “Cinque” Magee Finally Released After Decades of Unjust Imprisonment
Ruchell “Cinque” Magee
Ruchell Magee, who had been one of the longest-held political prisoners in the U.S., finally won his release last month from a California prison after spending 67 of his 84 years behind bars. Through decades of unjust imprisonment, including some 17 years of torture in isolation cells, Magee has inspired many with his unrepentant stand and outspoken voice against what he has denounced as “the entire system, judicial and prison system, a system of slavery.”
Born in Louisiana in , Ruchell Magee grew up in a society marked with Ku Klux Klan terror, violent “official” repression, and blatant discrimination against Black people. When he was 16, Magee was accused of raping a white woman. This was the very same year, , that a gang of whites in Mississippi lynched year-old Emmett Till and threw his body into a river—because Emmett whistled at a white woman. Magee wasn’t lynched… but he was declared “guilty” by an all-white jury in a “trial” lasting less than a day. The teenage Magee was sentenced to 12 years of hard labor
New Afrika History
Ruchell Cinque Magee is the longest held political prisoner in the world, he has been in jail for more than 42 years, his captives hold him in violation of the law and the Constitution. His is the classic case of fraud and corruption at the highest levels of government, and involves the executive, legislative and judicial branches of Government in a mind boggling conspiracy to hide the truth, and deny him due process. This democratic Government has committed fraud to cover up two not guilty verdicts by two different juries in two different trials.
Ruchell has been beaten by guards in the Court room in front of a jury, while Judge Herbert V. Walker watched and did nothing. He also instructed the jury that they had to find Ruchell either guilty or insane; a Federal Judge, Sam Conti, called Ruchell a moron and created false documents in furtherance of the conspiracy; denied self-representation; prevented Ruchell from meeting with the media (James Earl Ray, the accused and convicted murderer of Luther King met with and talked to the press when he wanted to); denied habeas corpus and sentenced to life in prison with no possibility of p
Ruchell Magee is one of the longest-held California prisoners who has been dubbed a political prisoner due to his spontaneous participation in the Marin Courthouse rebellion– the famous incident that spawned Black August. He is serving a sentence of 7 years to life for a nonviolent disagreement that landed him the wrongful charge of ‘kidnapping to commit robbery.’ Years later, he happened to be in the courthouse for unrelated reasons when Jonathan Jackson entered to free his brother and Black Liberation icon George Jackson. According to a sworn affidavit from one of the jurors, the jury voted for acquittal on charges from the Courthouse rebellion, however, this acquittal has been obscured and he continues his fight to expose this.
Ruchell is now 82 years old, and has spent more than 58 years in prison. From behind bars, he has been a positive force by helping many people with his tireless work as a jailhouse lawyer. He currently has a pro se motion pending review by the Supreme Court as well as a commutation application to be reviewed by the Governor. He is also parole eligible.
